Ground Lease Agreement

A Ground Lease Agreement is a long-term lease between a property owner and a tenant, where the tenant can use the land for development or business while the landowner retains ownership. These agreements include terms about rent, land use and responsibilities such as paying property taxes or maintaining improvements. At the end of the lease, any improvements may revert to the landowner depending on the terms.

Property owners and prospective tenants or developers complete this agreement when leasing land for commercial, industrial or long-term residential use.

Once signed, the agreement should be filed with your attorney, recorded with your county office if required and kept by both parties for legal and reference purposes.
