Purpose and legal effect of an employment contract

The employment contract constitutes the primary legal instrument governing the employment relationship. This contract is a general template and must be adapted to reflect the specific circumstances of the employment arrangement. It includes default provisions relevant to full-time, part-time, casual, and trainee employment under a modern award. Employers are required to tailor the content to align with operational needs, industry practice, and lawful entitlements.


Consistency with industrial instruments

Employers must ensure that this contract does not contravene the minimum entitlements conferred by a modern award, enterprise agreement, or National Employment Standards (NES). In the event of any inconsistency, the applicable industrial instrument will prevail to the extent of the inconsistency.
