Purpose and legal effect of a performance improvement plan
A Performance Improvement Plan (PIP) is a formal written tool used to identify, document, and address unsatisfactory performance by an employee. It outlines specific areas for improvement, sets measurable performance expectations, provides support mechanisms, and specifies timeframes for review. Although not a disciplinary sanction in itself, a PIP forms part of a procedurally fair performance management process and may be used to support further action, including termination, if performance does not improve.
This template has been designed to:
- Clearly articulate the areas of underperformance with reference to the employee’s duties, performance standards, or KPIs;
- Establish reasonable, measurable objectives and timelines for improvement;

Procedural fairness and compliance
Before issuing a PIP, the employer should:
- Clearly identify the concerns and provide examples of underperformance;
- Invite the employee to a meeting to discuss the issues and give them an opportunity to respond;
- Consider the employee’s explanation before finalising the plan; and
- Ensure the employee understands the expectations, support offered, and consequences of failing to meet the plan objectives.

Supplementary notes
